  • There are EIGHT questions divided in TWO SECTIONS and printed both in HINDI and in ENGLISH.
  • Candidate has to attempt FIVE questions in all.
  • Questions no. 1 and 5 are compulsory and out of the remaining, any THREE are to be attempted choosing at least ONE from each section.
  • The number of marks carried by a question / part is indicated against it.
  • Answers must be written in the medium authorized in the Admission Certificate which must be stated clearly on the cover of this Question-cum-Answer (QCA) Booklet in the space provided.
  • No marks will be given for answers written in a medium other than the authorized one.
  • Word limit in questions, wherever specified, should be adhered to.
  • Attempts of questions shall be counted in sequential order.
  • Unless struck off, attempt of a question shall be counled even if attempted partly.

Q1. निर्णयों की सहायता से अपने उत्तर का समर्थन कीजिए । Answer the following in about 150 words each. Support your answer with legal provisions and judicial pronouncements. 10×5 = 50 “आपराधिक दायित्व की मात्रा के निर्धारण में विधि अपराधी के हेतु, पैमाने व चरित्र पर (a) विचार करती है ।” कानूनी अपराधों में आपराधिक मन:स्थिति की अनुपस्थिति के प्रकाश में इस कथन का परीक्षण कीजिए । "In determining the quantum of criminal liability, the law takes into account the motive, magnitude and character of the offender." Examine this statement in the light of absence of mens rea in statutory offences. 10 “भ्रष्टाचार निवारण अधिनियम, 1988, लोक सेवकों को अपनी आधिकारिक क्षमता के (b) दुरुपयोग एवं दुष्प्रयोग करने से रोकता है।” टिप्पणी कीजिए । "The Prevention of Corruption Act, 1988 prevents the public servants from misuse and abuse of their official capacity." Comment. 10 “अभी हाल में त्रुटिहीन दायित्व के नियम में भारी परिवर्तन आया है।” टिप्पणी कीजिए। (c) "No fault liability rule has undergone a drastic change in the recent X. past." Comment. 10 “वादी के केवल दोषमुक्त हो जाने से, दुर्भाव (द्वेष) अनुमानित नहीं हो सकता । दोषमुक्ति के (d) अलावा, वादी को यह सिद्ध करना आवश्यक होता है कि उसका अभियोजन द्वेषपूर्वक व बिना यथोचित व सम्भावित कारण के हुआ था।" टिप्पणी कीजिए। "Malice is not to be inferred merely from the acquittal of the plaintiff. The plaintiff must prove independently of the acquittal that his prosecution was malicious and without reasonable and probable cause."
