  • लालकुर्ती मेरट में सम्पन्न हुई । 11 जून, 2012 को मनीषा अपने पति हरीश के घर हरिद्वार आ गई । 3 जुलाई, 2012 को मनीषा की तबियत कुछ बिगड़ी ।
  • हरीश मनीषा को लेकर जिला अस्पताल हरिद्वार गया ।
  • वहाँ महिला डॉ. स्मिता ने परीक्षण करने के बाद हरीश को बधाई देते हुए बताया कि मनीषा दो महीने से गर्भवती है ।
  • हरीश, मनीषा को दो महीने से गर्भ है सुनकर अचम्भित हो गया । 16 जुलाई, 2012 को हरीश, वकील से मिलकर विवाह को इस आधार पर कि मनीषा विवाह से पूर्व ही किसी व्यक्ति द्वारा गर्भवती हो गई, शून्य घोषित करने के लिए मनीषा और उसके माता-पिता के विरुद्ध धोखाधड़ी का वाद दायर कराने का आग्रह करता है।
  • यहाँ विवाह शून्य करने हेतु हरीश की तरफ से मनीषा और उसके माता-पिता के विरूद्ध एक वाद पत्र लिखिए । 30 उपर्युक्त वाद पत्र के उत्तर में प्रतिवादी मनीषा और उसके माता-पिता की ओर से लिखित कथन का प्रारूप भी लिखिए । 10 UJS-04 1

(a) एक अठारह वर्षीय सुन्दर लड़की, नेहा, इलाहाबाद के डी.ए.वी. इन्टर कॉलेज में 12वीं कक्षा को छात्रा है । कॉलेज में अकसर कुछ लड़के लड़कियों पर छोंटा-कसी करते रहते हैं । एक दिन कुछ लड़कियाँ जिनमें नेहा भी शामिल थी, कॉलेज के प्राचार्य डॉ. हरदेव के ऑफिस में उन लड़कों के विरुद्ध शिकायत करने गयीं । दूसरे दिन प्राचार्य ने उन लड़कों को अपने ऑफिस में बुलाया और उन्हें सूना । प्राचार्य ने सख्त चेतावनी देते हुए कहा कि यदि भविष्य में ऐसी कोई शिकायत मिली तो उन्हें कॉलेज से निष्काषित कर दिया जायेगा । A beautiful young girl of 18 years, Neha is a student of 12th class in D.A.V. Inter College, Allahabad. Some students generally used to tease girls. One day some girls including Neha went to the office of the Principal Dr. Hardeo to make a complaint against those students. Next day Principal called those students in his office and heard them. The Principal warning them strictly said if any such complaint is received in future they will be expelled from the college.

(b) 25 अगस्त, 2013 को जब नेहा कॉलेज पुस्तकालय से लौट रही थी तो दो छात्रों ने जो उसी की कक्षा के थे, उसे रोका उनमें से एक ने अपना हाथ नेहा के कंधे पर रखा और दूसरे ने उसे चूमा । दोनों ने नेहा को धमकी दी कि यदि किसी को इसकी शिकायत की तो वे तेजाब से उसका चेहरा बिगाड़ देंगे । उपर्युक्त तथ्यों के आधार पर प्रकरण बनाकर निर्णय भी लिखिए । After 4 days i.e. on 25th of August, 2013 when Neha was returning from her college library, two students of her class stopped her. One of them put his hand on Neha's shoulder and the other kissed her. Both of them threatened her that if she made any complaint of this, they will deface her by acid. On the basis of the above facts, prepare a case and give decision.
