(स) ‘अ’ धोखे से ‘ब’ को विश्वास दिलाता है कि जमीन ‘अ’ की है व ‘ब’ को जमीन खरीदने के लिए कहता है और ‘ब’ जमीन खरीद लेता है, जबकि जमीन ‘अ’ के पिता ‘फ’ की है। ‘फ’ की मृत्यु हो जाती है। ‘अ’ चूँकि ‘फ’ का पुत्र है, वह ‘फ’ की जमीन को प्राप्त करता है। ‘ब’ जमीन का कब्जा देने के लिए कानूनी दावा करता है। ‘अ’ तर्क देता है कि जमीन को बेचने के वक्त वह उसका मालिक नहीं था । अतः वह ‘ब’ को जमीन बेचने का अधिकार भी नहीं रखता था । निर्णित केस को इंगित करते हुए निर्णय कीजिए।

(a) What is meant by 'frustration of contract' ? What are the prerequisites for excusing parties from performing the contract on the ground of frustration?

(b) Examine the validity of the following Hindu Marriages:
(i) Marriage of a 20 years old boy to an eighteen years old girl.
(ii) Marriage of a man to the widow of his elder brother.
(iii) Marriage of A and B solemnized in Roorkee by exchange of garland.

(c) A falsely leads B to believe that a land belongs to A and thereby induces B to purchase it. 'B' purchase it. The land actually belonged to A's father, F. F died.A being the son of F, inherited the land. B sues A for possession of that land. A pleads that B is not entitle to the land as at the time of sale. A was having only spes successionis. Decide referring to decided cases, if any.

(अ) ‘अ’ एक हिन्दू पुरुष अपनी अलग सम्पत्ति को बिना वसीयत किए मृत्यु को प्राप्त हो जाता है। अपने पीछे वह अपना पिता 'फ', माता 'म', विधवा 'व', पुत्र 'प', पुत्री 'स', दूसरे दिवंगत पुत्र की विधवा, पुत्र, पुत्री, दिवंगत पुत्री का विधुर पुत्र, पुत्री छोड़ गया । मृत्यु के समय उसका जीवित पुत्र जेल में था एवं उसके ऊपर बलात्कार की सजा काट रहा था। निर्णय कीजिए ‘अ’ की सम्पत्ति का उत्तराधिकार किसके पास जाएगा और उनका हिस्सा क्या होगा ?

(ब) “हिताधिकारी के हित की सुरक्षा न्यास विधि की प्रमुख चिन्ता है।” न्यास भँग होने की स्थिति में हिताधिकारी को उपलब्ध उपचारों की विवेचना कीजिए।

(स) किन परिस्थितियों में व्यक्तियों के समूह को भागीदारी फर्म कहा जा सकता है ? भागीदारों की एक दूसरे के प्रति व तीसरे व्यक्ति के प्रति कर्त्तव्यों की विवेचना कीजिए।

(a) A, a male Hindu dies intestate leaving behind his separate property. He is survived by his father F, mother M, widow W, a son S, and a daughter D. He is also survived by the widow, son and daughter of his predeceased son S, and widower, son and daughter of his predeceased daughter D2. At the time of A's death, S, was in prison as he was convicted for the offence of rape. Decide who would inherit A's property and what would be their shares.
