- (अ) विनिर्दिष्ट अनतोष अधिनियम, 1963 के अन्तर्गत किसी ऐसे व्यक्ति को क्या उपचार प्रदान किये गये हैं (ৰ) जिसको उसकी अचल सम्पत्ति से बेकब्जा कर दिया गया हो ? वर्णन कीजिये । 10 ‘‘स्वीकृति प्रस्ताव के लिए वही कार्य करती है जो एक बारूद से भरी हुई रेलगाड़ी के लिए जलती हुई (F) माचिस को एक तिल्ली ।" (प्रो. ऐन्सन) इस कथन को स्पष्ट करते हुए, स्वीकृति की परिभाषा तथा स्वीकृति का प्रस्ताव के साथ सम्बन्ध स्पष्ट कोजिये । 15 "Once a mortgage is always a mortgage." Discuss the statement. (a) What remedies are available under Specific Relief Act, 1963 to a person who has (b) been dispossessed from his immovable property? Illustrate. "Acceptance is to proposal what a lighted match-stick is to a train full of gun- (c) powder." (Prof. Anson) Explain the statement and mention the definition of acceptance and describe the relationship of acceptance with proposal. ‘‘एक संविदा में पर-व्यक्ति को संविदा विधि कोई अधिकार प्रदान नहीं करती है ।’’ कथन को स्पष्ट
- (3) करते हुए, भारतीय संविदा अधिनियम, 1872 में वर्णित अपवादों का उल्लेख कोजिये । 15 ‘‘एक अचल सम्पत्ति का पट्टा स्वत: ही समाप्त नहीं होता है ।’’ अत: उन परिस्थितियों का वर्णन कीजिये (ৰ) जिनके कारण अचल सम्पत्ति का पट्टा समाप्त हो जाता है तथा पट्टे व अनुज्ञप्ति (लाइसेंस) में भी अन्तर स्पष्ट कोजिये । 15 ‘‘भारतीय साझेदारी अधिनियम, 1932 ने पंजीकरण को अनिवार्य किये बिना ही बड़े प्रभावी ढंग से फर्म (ম) के पंजीकरण को अनिवार्य (सुनिश्चित) कर दिया है ।" कथन की विवेचना कीजिये तथा फर्म के अपंजीकरण के प्रभाव बताइये । 10 UJS-03 1
