- (iii) एक प्रश्न के सभी भागों का उत्तर अनिवार्यत: एक साथ दिया जाय । Candidates should attempt all the three questions. Notes:

Q1. Dismissal, removal or reduction in rank of persons employed in civil capacities under Union or a State – No person, who is member of civil service of the Union or an All India service or a civil service of a State or holds a civil post under the Union or a State shall be dismissed or removed by an authority subordinate to that by which he was appointed.
Q2. Translate the following Hindi passage into ordinary English language :
(a)
जिला न्यायाधीशों की नियुक्ति - किसी राज्य में जिला न्यायाधीश नियुक्त होने वाले व्यक्तियों की नियुक्ति तथा जिला न्यायाधीश की पदस्थापना और प्रोन्नति उस राज्य का राज्यपाल ऐसे राज्य के सम्बन्ध में अधिकारिता का प्रयोग करने वाले उच्च न्यायालय से परामर्श करके करेगा ।
वह व्यक्ति जो संघ की या राज्य की सेवा में पहले से नहीं है, जिला न्यायाधीश नियुक्त होने के लिए केवल तभी पात्र होगा जब वह कम से कम सात वर्ष तक अधिवक्ता या प्लीडर रहा हो और उसकी नियुक्ति के लिए उच्च न्यायालय ने सिफारिश की हो ।
कुछ जिला न्यायाधीशों की नियुक्तियों का और उनके द्वारा किए गए निर्णयों आदि का विधिमान्यकरण - किसी न्यायालय का कोई निर्णय, डिक्री या आदेश होते हुए भी, -
उस व्यक्ति की जो राज्य की न्यायिक सेवा में पहले से ही हो या उस व्यक्ति की जो कम से कम सात वर्ष अधिवक्ता या प्लीडर रहा हो, उस राज्य में जिला न्यायाधीश के रूप में नियुक्ति की बाबत,
और ऐसे व्यक्ति की जिला न्यायाधीश के रूप में पदस्थापना, प्रोन्नति या अन्तरण की बाबत, जो संविधान (बीसवाँ संशोधन) अधिनियम, 1966 के प्रारम्भ से पहले किसी समय अनुच्छेद 233 या अनुच्छेद 235 के उपबन्धों के अनुसार न करके अन्यथा किया गया है, केवल इस तथ्य के कारण कि ऐसी नियुक्ति, पदस्थापना, प्रोन्नति या अन्तरण उक्त उपबन्धों के अनुसार नहीं किया गया था, यह नहीं समझा जाएगा कि वह अवैध या शून्य है या कभी भी अवैध या शून्य रहा था;
किसी राज्य में जिला न्यायाधीश के रूप में अनुच्छेद 233 या 235 के उपबन्धों के अनुसार न करके अन्यथा नियुक्त, पदस्थापित, प्रोन्नत या अंतरित किसी व्यक्ति द्वारा या उसके समक्ष संविधान (बीसवाँ संशोधन) अधिनियम, 1966 के प्रारंभ से पहले प्रयुक्त अधिकारिता की, पारित किए गए या दिए गए निर्णय, डिक्री, दंडादेश या आदेश की ओर किए गए अन्य कार्य या कार्यवाही की बाबत केवल इस तथ्य के कारण कि ऐसी नियुक्ति, पदस्थापना, प्रोन्नति या अंतरण उक्त उपबन्धों के अनुसार नहीं किया गया था, यह नहीं समझा जाएगा कि वह अवैध या अविधिमान्य है या कभी भी अवैध या अविधिमान्य रहा था ।
