Q1.

(a) The plaintiff was again admitted in the said hospital due to the vascular problem and his operation was conducted. He remained admitted in the said hospital from 17.03.2022 to 22.03.2022 and incurred further medical expenses of Rs. 1,30,401/- for his vascular operation. He had to pay the said amount from his own pocket as again cashless medical facility was not provided to him by the defendant. The plaintiff on account of the said deficiency in services of the defendant, he approached the District Consumer Forum for seeking compensation against the defendant.
Analyze the case and draft an order after going through the relevant legal provisions and case law, if any.

(a) प्रतिवादी एक बीमा कंपनी है और उसने वादी को स्वास्थ्य बीमा पॉलिसी जारी की थी, जो 21.11.2021 से 20.11.2023 तक वैध थी। यह आरोप लगाया गया है कि उक्त पॉलिसी के तहत चिकित्सा उपचार के लिए कैशलेस सुविधा शामिल थी और इसकी बीमित राशी 2 लाख रुपये थी। वादी ने दावा किया है कि उसने उक्त पॉलिसी का पूरा प्रीमियम चुकाया था। यह आरोप लगाया गया है कि 23.02.2022 को वादी को अपने दिल में समस्या महसूस हुई और इसलिए वह अपने इलाज के लिए सर गंगा राम अस्पताल गया। उक्त अस्पताल में, उसने अपने डॉक्टरों को बताया कि उसके पास कैशलेस चिकित्सा सुविधा का बीमा कवर है। तदनुसार, वादी को कैशलेस सुविधा प्रदान करने के लिए प्रतिवादी को कई पत्र लिखे गए, लेकिन सभी व्यर्थ। अंत में, 01.03.2022 को वादी अपने इलाज के लिए उक्त अस्पताल में भर्ती हुआ। इसके बाद उक्त अस्पताल में उनके हृदय का ऑपरेशन किया गया। वह 01.03.2022 से 09.03.2022 तक उक्त अस्पताल में भर्ती रहा। उसे अपने चिकित्सा व्यय के लिए उक्त अस्पताल को 1,86,488/- रुपये की राशि अपनी जेब से देनी पड़ी क्योंकि प्रतिवादी द्वारा उसे कैशलेस चिकित्सा सुविधा उपलब्ध नहीं कराई गई थी।
वादी को संवहनी समस्या के कारण फिर से उक्त अस्पताल में भर्ती कराया गया था और उसका ऑपरेशन किया गया था। वह 17.03.2022 से 22.03.2022 तक उक्त अस्पताल में भर्ती रहा और उसके संवहनी ऑपरेशन के लिए 1,30,401/- रुपये का अतिरिक्त चिकित्सा व्यय हुआ। उसे उक्त राशि अपनी जेब से देनी पड़ी क्योंकि प्रतिवादी द्वारा उसे फिर से कैशलेस चिकित्सा सुविधा उपलब्ध नहीं कराई गई थी। प्रतिवादी की सेवाओं में उक्त कमी के कारण वादी ने प्रतिवादी के खिलाफ मुआवजे की मांग के लिए जिला उपभोक्ता फोरम का दरवाजा खटखटाया।
