(a) Fraud, which vitiates the contract, must have nexus with the acts of the parties prior to entering into the contract. Explain. कपट, जो संविदा को भंग करता है, का संबंध पक्षकारों द्वारा संविदा करने से पूर्व के उनके कार्यों से होना चाहिए। स्पष्ट कीजिए।

Q5. Examine the nature of the following agreements. Give reasons in support of your answer :
निम्नलिखित करारों की प्रकृति का परीक्षण कीजिए। अपने उत्तर के समर्थन में कारण दीजिए:

(a) A, an accused, is required under the Criminal Procedure Code to furnish a surety in the sum of five thousand rupees for his good behaviour. He deposits the sum with B and persuades him to become surety. B agrees to it. After the period of suretyship is over, the accused A sues B for the amount. A, जो एक अभियुक्त है, को दण्ड प्रक्रिया संहिता के अन्तर्गत, अपने अच्छे व्यवहार के लिए पाँच हजार रुपए की प्रतिभू प्रस्तुत करनी है। वह उक्त धनराशि B के पास जमा कर देता है तथा उसे प्रतिभू बनने के लिए मना लेता है। B उसके लिए तैयार हो जाता है। प्रतिभूत्व की अवधि बीत जाने के उपरान्त अभियुक्त A उक्त धनराशि के लिए B के विरुद्ध वाद प्रस्तुत करता है।

(b) A and B, two wrestlers, agreed to play a wrestling match on the condition that the party failing to appear on the day fixed was to forfeit ₹ 500 to the opposite party and the winner was to receive ₹ 1,500 out of the proceeds. B failed to appear on the day fixed. Thus, A sues B for the amount. A तथा B, दो पहलवान, एक कुश्ती मैच खेलने के लिए इस शर्त पर सहमत होते हैं कि जो पक्ष नियत तिथि पर उपस्थित नहीं होगा उसे विपक्षी को जुर्माने के रूप में ₹ 500 देने होंगे तथा विजेता प्राप्त राशि में से ₹ 1,500 प्राप्त करेगा। B नियत दिन को उपस्थित होने में असफल रहा। अत: A उक्त धनराशि के लिए B के विरुद्ध वाद लाता है।
